A Rhode Island federal district court granted a preliminary injunction to American Federation of Government Employees Local 2305 and AFGE National VA Council on their First Amendment retaliation and Administrative Procedure Act claims against the Department of Veterans Affairs and its Secretary, finding the unions were likely to succeed in showing that the VA’s termination of their master collective bargaining agreement was retaliation for their protected speech, and constituted arbitrary and capricious agency action.
