The U.S. Court of Appeals for the D.C. Circuit granted enforcement of the National Labor Relations Board’s order finding that Vermont Information Processing illegally terminated a software engineer under the National Labor Relations Act for creating and disseminating a salary-sharing spreadsheet, which constituted protected concerted activity, but vacated the board’s findings regarding three other software engineers because the Board impermissibly expanded its theory beyond the scope of the original complaint.
