The United States Court of Appeals for the Fifth Circuit granted Starbucks Corporation’s petition for review and vacated the National Labor Relations Board’s decision that union organizer and shift supervisor James Schenk was terminated in violation of the National Labor Relations Act for his union activities, finding the Board failed to adequately consider contradictory evidence that his termination was for legitimate workplace infractions including extreme profanity, failure to complete tasks, and opening company mail.
