Arbitrator Gregory P. Szuter ruled that the city of Tallmadge violated its CBA when it used the article 23.02 on-call list—that assigned each team member to three or four days on the list without regard to seniority—to select a police officer to fill a one-day staff shortage, instead of assigning the most junior officer. He found that the plain meaning of the agreement allows use of this list only when an officer “calls off sick” and this brings “staffing for a shift below the required minimum” and neither of these conditions existed here.
