Arbitrator David P. Mudrick ruled that the Kansas City Board of Public Utilities (BPU) violated a CBA when it improperly excluded three new positions that it deemed professional—GIS Analyst 1, GIS Analyst 2, and Senior GIS Analyst—from the bargaining unit for clerical employees represented by International Brotherhood of Teamsters, Local 53. The contract states that bargaining unit exclusions will be made “only if new classifications are supervisory, managerial or confidential” as defined in the CBA, the arbitrator found, noting the recognition clause lists exclusions from unit employees, and the list doesn’t include professionals.
