Nouryon Surface Chemistry LLC didn’t violate the collective bargaining agreement when it paid 12-hour shift employees straight-time, overtime, and double-time rates per the CBA, Arbitrator Richard Van Kalker held. The International Chemical Workers Union Council/United Food and Commercial Workers, Local 894C claimed that employees on 48-hour work weeks had their overtime pay reduced when receiving double-time pay during that period after working a seventh consecutive day.
