Arbitrator Dinah E. Wagner ruled that Transdev Services had just cause to terminate the grievant mechanic for excessive tardiness and absenteeism under the points system outlined in the company’s collective bargaining agreement with the Amalgamated Transit Union. While the union argued that there had been clerical errors in recording the number of instances the grievant was tardy and how many points he should have on his record, the available evidence was sufficient to definitively show that the grievant had legitimately assessed enough points under the system to be justifiably terminated. Therefore, Arbitrator Wagner denied the union’s grievance.
