Arbitrator Robert A. Creo ruled that the Borough of West Mifflin didn’t have sufficient just cause to discharge the grievant for an incident involving a confrontation with his supervisor. While the grievant, a sanitation worker, admitted to a level of fault during the investigation and subsequent hearing (and the union agreed that some level of discipline was warranted), the borough’s investigation of the incident wasn’t fair and full.
