Arbitrator Amy L. Sergent ruled that the employer, a nationwide car rental company, had just cause to discharge the grievant for engaging in immoral conduct through his failure to follow company policies. Specifically, Arbitrator Sergent found that the grievant had, in fact, willfully circumvented the company’s anti-fraud policies and procedures and therefore engaged in immoral conduct while on duty as described in the collective bargaining agreement. The union’s arguments that the company failed to go through the progressive discipline steps and that the company had disciplined other employees less severely for comparable infractions were rejected.
