The Second Circuit vacated a New York federal court’s grant of summary judgment to CSX Transportation on the claims of a train conductor that he was discharged for whistleblowing regarding safety issues with his supervisors’ work orders, in violation of the Federal Railroad Safety Act, ruling there was sufficient evidence that the conductor was subject to hostility from his supervisors about his concerns before lodging his complaint, and that his protected activity contributed to his discharge.
