A federal district court properly dismissed a 14th Amendment substantive due process claim against the governor of Washington and health care system PeaceHealth by the nonprofit’s employees terminated after refusing the Covid-9 vaccine, where refusal of an investigational drug is indistinguishable from refusal of an identical vaccine for which penalties are permissible and legitimate, and public health concerns superseded their right to refuse the vaccine, the Ninth circuit held.
