The Supreme Judicial Court of Massachusetts upheld the Commonwealth Employment Relations Board’s decision finding substantial evidence that a police sergeant and union president’s transfer by the City of Newton’s police chief from a day shift to a night shift position was retaliatory, where the court found the city failed to justify the transfer with evidence of misconduct, it was an adverse action, and retaliatory against the officer’s union activities.
