The Arkansas Supreme Court reversed a circuit court’s grant of summary judgment to a substitute teacher on her retaliation claims under the Rehabilitation Act, 42 U.S.C. § 1983, and the Arkansas Civil Rights Act against Benton School District and two administrators who kept her from working in the district after she filed an ethics complaint about her child’s teacher, ruling that her Rehabilitation Act claim failed because she wasn’t a school district employee, her § 1983 and ACRA claims failed for lack of a school district policy causing constitutional violations, and because her ethics complaint wasn’t protected speech.
