The Virginia Court of Appeals partially reversed and partially affirmed a circuit court’s decision overruling Sentry Force Security, LLC’s plea in bar to a counterclaim under Virginia Code § 40.1-28.7:8, holding that the statute allows employers to prohibit former low-wage employees from soliciting the employer’s customers but does not allow prohibition of soliciting the employer’s employees, in a case involving an office manager who started his own competing security company while still employed by Sentry Force.
