A California federal district court denied Luminate Home Loans, Inc.'s motion to dismiss counterclaims brought by a former NEO Division President and a former NEO Home Loans manager under California Business & Professions Code § 16600.5 to void a noncompete clause, defamation claims based on statements to Florida employees that the counterclaimants had lied about loan collections, and related Unfair Competition Law claims, finding the noncompete provision appeared to prohibit working for competitors without applicable exceptions and the alleged defamatory statements were sufficiently pleaded as factual, false, and potentially injurious.
