Software consultant Perficient Inc. is entitled to summary judgment on its breach of contract claim against a terminated vice president with confidential information regarding key customers, who allegedly violated non-competition and confidentiality agreements in his employment contract by going to work for a competitor, a federal court in Missouri ruled. While a “competitive business” restrictive covenant was found to be overbroad, the court concluded that a “competitive duties” provision is reasonable to protect the company’s interests for at least 12 months after termination.
