An Arkansas federal district court partially granted TMS International, LLC’s motion for preliminary injunction against Edw. C. Levy Co. on claims of tortious interference with contract, enjoining Levy from soliciting TMS employees with noncompete agreements and from employing former TMS employees with such agreements within one year of separation, finding TMS would suffer irreparable harm due to the scarcity of trained employees in the competitive steel mill industry, but denied the motion against three former operations supervisors because TMS failed to demonstrate irreparable harm given that their one-year noncompete periods had nearly or already expired.
