Federal Express Corporation is entitled to summary judgment on the race discrimination and negligence claims of an at-will employee who lost custodial control of a package in violation of company policy. The employee conceded his race discrimination claim by not opposing FEDEX’s arguments expressed in its summary judgment motion. Further, the employee failed to create a genuine issue of material fact that FEDEX was negligent by providing him with an unsecure truck. Both pre- and post-trip inspections found nothing wrong with the truck he drove, the court said. The case is Wilson v. Fed. Express Corp., 2019 BL 422845, D.D.C., No. 1:18-cv-00485 (APM), 11/4/19
