A Pennsylvania federal district court denied the city of Philadelphia’s motion for summary judgment on the First Amendment retaliation claim of a police officer allegedly punished for insubordination after taking a photo of another officer suspected of stealing time in order to expose corruption, where taking the photograph as a private citizen is protected speech, and whether the photography was substantially related to alleged retaliation is a question for a factfinder.
