A Pennsylvania federal district court partially denied the City of Philadelphia’s motion to dismiss a female deputy director’s equal protection claim under 42 U.S.C. § 1983, finding that the deputy director sufficiently alleged a municipal policy of sex discrimination by showing that the mayor, as a final policymaker, twice passed her over for promotion in favor of less qualified men and allegedly stated he “wanted a male employee” to lead the Department of Labor.
