A Pennsylvania federal district court partially denied the Borough of New Holland’s motion to dismiss the 42 U.S.C. § 1983 equal protection claim of a female police officer terminated on the last day of her one-year probationary period and on the same day she was set to go on medical leave pending abdominal surgery, where the Borough didn’t address her equal protection claim, and her due process claim cannot survive dismissal because of her status as an at-will employee.
