A Texas appellate court held claims by a pipeline technician whose drug test result was voided for high creatine levels weren’t based on a communication on a matter of public concern, as defined by the Texas Citizens’ Participation Act, and affirmed denial of Quattro Operating’s motion to dismiss, after it allegedly falsely communicated about his termination and didn’t keep his drug test results confidential, when its president sent an email stating the employee violated a substance abuse policy.
