An Illinois federal court granted two employees’ motion to strike Global Intermodal Transport’s at-will employment and estoppel affirmative defenses in response to the employees’ Fair Labor Standards Act and state law breach of contract and unpaid wages claims, after Global terminated them asserting financial struggle and restructuring, where Global didn’t admit the complaint’s factual allegations, and the company’s denial that the employees were to be paid unused vacation time is insufficient.
