Physicians Hair Transplant Center, Inc. isn’t entitled to a grant of summary judgment on a former salesperson’s claims alleging the hair transplant clinic withheld two months of her sales commissions and failed to pay her for overtime work, in breach of her employment contract and the Fair Labor Standards Act, a federal court in Georgia ruled. Her status as an at-will employee doesn’t preclude a breach of contract action for unpaid commissions under Georgia law, the court said.
