Vivint Solar Developer, LLC may not compel arbitration of the claims of a job applicant whose conditional offer of employment was rescinded, in which he alleges that it failed to hire him for a sales consultant position in violation of the Criminal History Record Information Act and the Philadelphia Fair Hiring Law, a federal court in Pennsylvania ruled. Vivint Solar couldn’t establish that it offered valuable consideration in exchange for the applicant’s offer to arbitrate claims, and its own promise to arbitrate was illusory, the court stated.
