The University of Pennsylvania isn’t entitled to summary judgment on a post-doctoral fellow’s retaliation claim under the Pennsylvania Whistleblower Law alleging that he was constructively discharged after reporting that his supervisor was forcing him to help his wife, who was also fellow, with medical residency applications during NIH-funded research time, a federal district court ruled. It’s unclear whether his reports were made in good faith and whether they sufficiently alleged that the university violated a law, the court said.
