A director-level employee’s firm denial that she signed Guess? Inc.'s employee arbitration agreement was enough to impeach the company’s evidence that she signed the document electronically and defeat its bid to keep her job discrimination and related claims out of court, the California Court of Appeal ruled. The employee also presented evidence from an information security expert, who stated that the technical security controls in Guess’ human resources self-service system for employees were insufficient to ensure that the electronic signature the company pointed to necessarily was hers, the court said.
