A Texas federal district court denied Jan X-Ray Services, Inc.'s motion to dismiss the claims of a female employee alleging sexual harassment by the male president of the company, retaliation and discharge for reporting his behavior, in violation of state law, ruling that there were sufficient pleadings that the company was constructively aware of the president’s actions, did nothing to remedy the situation, pushed her out of the company, and that its reason for the discharge was pretextual.
