A New York federal district court denied KSH Aviation LLC’s motion to dismiss discrimination and retaliation claims under Title VII of the Civil Rights Act, as well as breach of contract and unpaid wage claims brought by a pilot, finding that the timing of the pilot’s termination and alleged comments by a partner supported an inference of discrimination and retaliation, and that the pilot’s allegations sufficiently established Title VII’s numerosity requirement and showed defendants were joint employers.
