A New York federal district court denied Magazzino Italian Art Foundation’s motion to compel arbitration of retaliation claims under Title VII of the Civil Rights Act and the New York State Human Rights Law brought by a male operations and facilities manager who alleged he was fired for reporting gender-based harassment of female employees, finding that the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021 prohibits forced arbitration because the manager’s complaints about gender-based harassment constitute “sexual harassment” under New York law.
