A Georgia federal district court partially denied Atlanta Public Schools’ motion to dismiss claims of age discrimination and retaliation under the Age Discrimination in Employment Act and interference and retaliation under the Family and Medical Leave Act brought by an over-60-year-old Pre-K teacher with a mental health disability, finding that she plausibly alleged her termination was motivated by age-based comments that she was “too old and needs to retire,” and that her FMLA claims were timely filed because the statute of limitations ran from the school’s non-renewal notice rather than an earlier rescinded termination notice.
