A Utah federal district court partially sustained and partially overruled objections to proposed jury instructions in a Title VII of the Civil Rights Act retaliation case brought by a female employee against Bristol Hospice Holdings, Inc., ruling that while instructions on business judgment and good faith belief were appropriate, instructions on at-will employment, temporal proximity, progressive discipline, and same-protected-class inference were unnecessary and unhelpful, and reserving judgment on the Kolstad good-faith defense for punitive damages pending evidence of the HR executive’s role.
