A New York federal district court denied in part the State of New York and New York State Insurance Fund’s motion to dismiss Title VII of the Civil Rights Act claims brought by a female claims service representative with Marcionite Christian religious beliefs prohibiting Covid-19 testing and vaccination, finding that she plausibly alleged the state was her joint employer and that sufficient temporal proximity existed between her protected activities of requesting religious accommodation and filing complaints and her suspension to support her retaliation claim.
