Shipbuilding employees of Austal USA, LLC are denied partial summary judgment on their Title VII of the Civil Rights Act claims seeking exemption or accommodation to a mandatory Covid-19 vaccination policy, an Alabama federal court ruled, where the cost of a bi-weekly Covid testing program would be over a million dollars a year, plus administrative costs, the company had a duty to protect the health of its employees, and the testing would pose a significant undue hardship on Austal USA.
