A New York federal district court denied the City of New York’s motion for summary judgment on a claim of failure to accommodate religious beliefs in violation of Title VII of the Civil Rights Act brought by a former assistant commissioner for training and development at the New York City Department of Correction who was terminated for refusing the Covid-19 vaccine, finding genuine disputes existed regarding the sincerity of the assistant commissioner’s Christian beliefs and whether weekly coronavirus testing as an accommodation would pose an undue hardship.
