The United States Court of Appeals for the Fifth Circuit affirmed a Texas federal district court’s certification of a subclass of customer-facing employees with religious accommodations under Title VII of the Civil Rights Act of 1964 who were placed on unpaid leave by United Airlines, Incorporated due to their refusal to comply with a Covid-19 vaccine mandate, finding that the district court didn’t abuse its discretion in determining that common questions of religious accommodation predominated and could be resolved class-wide despite United’s arguments about individualized inquiries into sincerity of beliefs and undue hardship.
