A Virginia federal district court denied summary judgment to Martin Marietta Materials, Inc. on racial and religious harassment claims under 42 U.S.C. § 1981 and Title VII of the Civil Rights Act by a welder who alleged that several colleagues made unwelcome insults about his race and religion, finding that a reasonable jury could conclude that his reports of the harassment to an hourly leadman could impute liability to the company and the comments were sufficiently severe and pervasive.
