A Nevada federal district court denied ITS Logistics, LLC’s motion to dismiss and motion for summary judgment on hostile work environment and retaliation claims under Title VII of the Civil Rights Act brought by a Black former senior leadership associate who alleged he was subjected to racial harassment and constructively discharged after complaining about it, finding he sufficiently exhausted administrative remedies for his retaliation claim and that a genuine dispute of material fact existed regarding whether agreements he signed constituted a valid waiver of his Title VII rights.
