A Tennessee federal district court denied Federal Express’s motion for summary judgment on race discrimination claims under Title VII of the Civil Rights Act of 1964 and 42 U.S.C. § 1981 brought by a Black lead aviation maintenance technician who was terminated for showing inappropriate videos at work, finding that whether a White manager who was reinstated after similar alleged misconduct was similarly situated to the technician was a jury question under binding Sixth Circuit precedent.
