A Louisiana federal district court granted summary judgment to CB&I on claims of race discrimination and retaliation under Title VII of the Civil Rights Act and 42 U.S.C. § 1981, and disability discrimination under the Americans with Disabilities Act, brought by a Black foreman who alleged he was demoted and later terminated due to his race, in retaliation for filing an EEOC charge, or because of his back injury, finding he failed to show that CB&I’s legitimate reasons were pretextual or that decision-makers knew of his protected activity.
