A New York federal district court denied summary judgment to Metro-North Commuter Railroad on the claims of a Black train conductor that he faced discrimination, and was terminated, due to his race, in violation of Title VII of the Civil Rights Act and Section 1983, ruling that there was sufficient evidence to suggest racially discriminatory pretext in Metro-North’s discharge of the conductor and its targeting of him with selective enforcement of safety rule violations.
