A Texas federal district court granted summary judgment to Lhoist North America of Texas on race discrimination and retaliation claims under 42 U.S.C. § 1981 brought by a Black truck driver, finding he failed to establish a prima facie case for either claim because he couldn’t prove he was qualified for promotions he sought, couldn’t show similarly situated employees were treated differently, failed to demonstrate he engaged in protected activity, and failed to show actionable adverse employment actions.
