A federal district court partially granted a Black female registered nurse’s motion to file a second amended complaint against the Board of Trustees of the University of Alabama, allowing her Title VII of the Civil Rights Act claims for race discrimination and retaliation to proceed while striking her hostile work environment, Americans with Disabilities Act, and 42 U.S.C. §§ 1981 and 1983 claims as futile because the Board has 11th Amendment immunity from most claims except Title VII, and her hostile work environment allegations failed to meet the “severe or pervasive” standard.
