An Alabama federal district court denied the City of Birmingham’s motion to dismiss a race discrimination claim under Title VII of the Civil Rights Act brought by a Black police sergeant who received verbal discipline for failing to adequately staff a vehicle checkpoint, finding that the verbal discipline could constitute an adverse employment action under the Muldrow framework and that the Black sergeant adequately alleged a similarly situated white sergeant was not disciplined for the same conduct.
