An Alabama federal district court denied as moot a sheriff’s motion to dismiss Title VII of the Civil Rights Act race discrimination claims brought by two Black former employees of the Colbert County Sheriff’s Department, while dismissing all claims against the department itself and dismissing § 1981 claims seeking retrospective relief against the sheriff, but allowing the Title VII claims and § 1981 claims seeking prospective relief against the sheriff to proceed after the EEOC completed its investigation and issued right to sue letters.
