Shawnee F, LLC, and Dobbs Equity Partners, LLC aren’t entitled to dismissal of a Black employee’s Title VII of the Civil Rights Act and 42 U.S.C. § 1981 claims alleging race discrimination, hostile work environment, and retaliation, based on alleged harassing conduct by White coworkers, which he reported to his supervisor and human resources to no avail, where he wasn’t required to exhaust remedies under a labor contract before pursuing his statutory claims, a Kansas federal court ruled.
