A Florida federal district court granted the Department of Homeland Security’s motion to dismiss age discrimination claims under the Age Discrimination in Employment Act, religious discrimination and retaliation claims under Title VII of the Civil Rights Act, and First Amendment claims brought by an age-protected, Christian deputy federal security director who was denied promotion, finding that he failed to plausibly allege age was the but-for cause of non-selection, failed to show religious discrimination when the selected candidate shared his faith, lacked temporal proximity for retaliation, and lacked jurisdiction for constitutional claims.
