A New York federal district court denied two White law enforcement officers’ motion for judgment as a matter of law and new trial on their race discrimination claims under Title VII of the Civil Rights Act against the New York State Department of Environmental Conservation, where the jury found race was a motivating factor in the denial of their promotions to director of law enforcement but that the employer would have made the same decision absent discrimination, ruling there was sufficient evidence to support the jury’s mixed-motive verdict.
