A New York federal district court denied summary judgment to Amazon Web Services and a supervisor on national origin discrimination and retaliation claims under the New York State Human Rights Law and New York City Human Rights Law brought by a terminated Chilean GTM specialist, finding genuine issues of material fact existed regarding whether discriminatory comments about his accent and English skills, differential treatment compared to American colleagues, and suspect timing between his human resources complaints and adverse employment actions showed the employer’s poor performance justification was pretextual.
