An Illinois federal district court denied Dart Container Corporation of Illinois’ motion to dismiss claims of race discrimination, national origin discrimination and retaliation under Title VII of the Civil Rights Act brought by a Hispanic maintenance mechanic of Mexican descent who alleged he was subjected to discriminatory discipline and terminated shortly after complaining about harassment, finding that he sufficiently exhausted his administrative remedies through his EEOC charges and adequately pleaded that he was treated differently based on his protected characteristics and faced retaliation for engaging in protected activity.
